ART. 1 GENERAL INFORMATION

These Contractual Conditions have as their object the purchase of products carried out remotely via the telematic network on the site  www.tabacchericolafrancesco.com owned by Tabaccheria Colafrancesco in the person of  Bellini Simona, with headquarters in Collegno (TO), Via Provana 26, post code 10093, p. IVA 06703100013, and hereinafter referred to as "Tabaccheriacolafrancesco" and the customer, hereinafter referred to as "Customer".

By Contract we mean the legal transaction governed by these articles, concerning the sale of products that the Customer orders from Tabaccheriacolafrancesco.

By Product we mean the good supplied by Tabaccheriacolafrancesco.
The contract is governed in the Italian language.

ART. 2 ORDERS

Orders can be placed through the site  www. tabaccheriacolafrancesco.com , accessible 24 hours a day, 7 days a week.
The quotations available and / or obtainable from the online quotation system are only valid for orders managed through the site  www.tabaccheriacolafrancesco.com .
Orders are considered automatically accepted under the conditions proposed on the site.

No order can be canceled after it has been shipped.

As required by the legislation in force, regarding the regulation of product sales on the Internet, the consumer may exercise the right of withdrawal, after the delivery of the order, within the times and in the manner prescribed by law and as better explained in art. 3 "contract withdrawal" of these contractual conditions.

ART. 3 WITHDRAWAL FROM THE CONTRACT

The Customer has the right to withdraw from the contract, without indicating the reasons, within 14 days. The withdrawal period expires after 14 days from the day in the case of a sales contract: "in which you or a third party, other than the carrier and designated by you, acquire physical possession of the goods.".
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by means of an explicit declaration (for example a letter sent by post or e-mail).

To meet the withdrawal deadline, it is sufficient for you to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, you will be reimbursed for any payments you have made to us, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery by us. offered), without undue delay and in any case no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. These refunds will be made using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise; in any case, he will not have to incur any costs as a consequence of this reimbursement.

Please return the goods or deliver them to us in the original packaging without undue delay and in any case within 14 days from the day on which you have notified us of your withdrawal from this contract. The deadline is met if you send back the goods before the 14-day period has expired. The costs of returning the products are borne by the user.

Exceptions to the Right of Withdrawal

The right of withdrawal pursuant to articles 52 to 58 for distance contracts and contracts negotiated away from business premises is excluded in relation to:

a) service contracts after the complete provision of the service if the execution began with the consumer's express agreement and with the acceptance of the loss of the right of withdrawal following the full execution of the contract by the professional;

b) the supply of goods or services whose price is linked to fluctuations in the financial market that the trader is unable to control and which may occur during the withdrawal period;

c) the supply of goods made to measure or clearly personalized;

d) the supply of goods which risk deteriorating or expiring rapidly;

e) the supply of sealed goods which are not suitable for return for hygienic reasons or related to the protection of health and have been opened after delivery;

f) the supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods;

g) the supply of alcoholic beverages, the price of which has been agreed upon at the time of the conclusion of the sales contract, whose delivery can only take place after thirty days and whose actual value depends on fluctuations on the market that cannot be controlled by the professional;

h) contracts in which the consumer has specifically requested a visit by the professional for the purpose of carrying out urgent repair or maintenance work. If, on the occasion of this visit, the trader provides services in addition to those specifically requested by the consumer or goods other than spare parts necessary to carry out maintenance or repairs, the right of withdrawal applies to such additional services or goods;

i) the supply of sealed audio or video recordings or sealed computer software which have been unsealed after delivery;

l) the supply of newspapers, periodicals and magazines with the exception of subscription contracts for the supply of such publications;

m) contracts concluded at a public auction;

n) the provision of accommodation for non-residential purposes, the transport of goods, car rental services, catering services or services relating to leisure activities if the contract provides for a specific date or period of execution;

o) the supply of digital content by means of a non-material support if the execution has begun with the express agreement of the consumer and with his acceptance of the fact that in this case he would have lost the right of withdrawal.
 

ART. 4 PRICES

The prices of the Products are those published by Tabaccheriacolafrancesco on the site  . www.tabaccheriacolafrancesco.com  And  they are expressed in euros. In the case of shipments abroad, customs fees, taxes and public contributions must be added.
Tabaccheriacolafrancesco reserves the power to unilaterally modify the prices of the price list, without prejudice to contracts already concluded prior to the date of modification of the price list.
The price will not change in relation to the numerical variations of the supplied product.

ART. 5 PAYMENT

The Customer can pay in the following ways:

ART. 6 DELIVERY TIMES

The delivery times expressed on the site are always to be understood as working days, excluding Saturdays.

Delivery times start from the moment of payment.

Delivery times are calculated from the day of receipt of the order, in the event that the order is concluded by 12 noon. In the event that the order is concluded after 12 noon, the delivery times they will take effect from the next working day.
The times calculated at the time of placing the order refer to the times for the preparation of the Product for shipment (delivery by Tabaccheriacolafrancesco to the express courier.

ART. 7 SHIPPING

Tabaccheriacolafrancesco, for the delivery of the Product, uses national couriers.
Shipping costs are charged to the customer and are expressly indicated in the order.

Tabaccheriacolafrancesco  can not be held responsible in any way for delays in the delivery of goods or the non-delivery of the same, if the delay or non-delivery were caused by exceptional or unforeseeable circumstances, such as by way of example civil riots, intentional damage, fires, floods, storms or supernatural events, disruption of an ISP or telecommunications provider, related to the performance of the contract.

Delivery will be made to the address indicated at the time of the order and as specified by the Customer.
Upon receipt of the goods delivered by the courier, the Customer, before accepting the package, must check the integrity of the packaging in front of the courier.
In the event that the packaging has suffered damage and / or more or less conspicuous bumps or in the event that the courier refuses to wait for the check on his part, the Customer must sign by putting the words "subject to control" on the bill of transport. This allows us to initiate a dispute procedure against the courier.

ART. 8 OBLIGATIONS OF THE CUSTOMER

The Customer is required, before submitting his purchase order, to carefully read these contractual conditions. The forwarding of the purchase order implies their full knowledge and acceptance.
Upon receipt of the Product, the Customer ascertains its compliance with the requirements of the order.

ART. 9 PRODUCT QUALITY AND QUANTITY GUARANTEE

Tabaccheriacolafrancesco delivers to the Customer a product compliant with the Contract, in the sense that it complies with the description made by Tabaccheriacolafrancesco on the site  www.tabaccheriacolafrancesco.com .
 

ART. 10 COMPLAINTS 

Any complaints can be made within 3 days of receipt of the Product. After this period, no complaints will be accepted. The complaint can be sent via e-mail to the address:  tabaccheriacolafrancesco@gmail.com
The Customer will be contacted for clarification within 2 working days of the request.

In case of return of the Product, please refer to art. 3 "Withdrawal from the Contract".
 

ART. 11  JURISDICTION

For all disputes relating to the interpretation or execution of contracts, the competent court will be, exclusively, the Court of Turin.
